WAIVER OF LIABILITY AND HOLD HARMLESS AGREEMENT FOR PARTY ON BOATS, LLC. FOR BOAT CRUISES AND SPONSORED CRUISES

This Waiver of Liability and Hold Harmless Agreement is applicable to all passengers on boat rides/cruises operated by Party On Boats, LLC.

1. I, the undersigned, wish to participate as a passenger on the recreational charter boat ride/cruise (the “Boat Ride”) being operated by Party On Boats, LLC and/or am the parent or guardian of a minor child and desire he/she to participate in the Boat Ride, and acknowledge my participation and/or the participation of said minor child in the Boat Ride is completely voluntary.

2. I UNDERSTAND THAT THERE ARE INHERENT RISKS INVOLVED WITH BOATING, including, but not limited to equipment failure, perils of the sea, harm caused by other vessels, acts of fellow participants, entering and exiting the water, swimming, boarding or disembarking boats, and activities on the docks.

3. In consideration of being permitted to participate in the Boat Ride, I, the undersigned, on behalf of myself, my spouse, legal representatives, heirs and assigns,hereby agrees to RELEASE, DISCHARGE and COVENANTS NOT TO SUE Party On Boats, LLC., their employees, owners, subcontractors, agents, whether actual or apparent, or any of their officers (hereinafter referred to as “RELEASEES”) from any and all liability, claims, demands, actions and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or any of the property belonging to me, whether caused by NEGLIGENCE OF THE RELEASEES, or otherwise, while a passenger, or while in, on, or upon the premises or body of water where the boat ride/cruise is being conducted.

4. I fully assume responsibility for my own safety (including, without limitation, following all directions of the boat's captain and crew) while participating in the Boat Ride, and verify that I am physically able to participate. I understand that life preservers are required on the Boat Ride at all times. I further understand consumption of alcoholic beverages heightens the risks inherent on the Boat Ride and consumption of alcohol is solely at my own risk.

5. I fully understand that the involved boat has limited medical facilities and that in the event of illness or injury appropriate medical care must be summoned by radio and treatment will be delayed until I can be transported to a proper medical facility. I agree in advance to these conditions.

6. No person associated with Party On Boats, LLC has made any express or implied representation to me that they or the boat's crew can or will perform safe rescues or render first aid. In the event I show signs of distress or call for aid I would like assistance and will not hold any person or entity responsible for their actions in attempting the performance or rescue or first aid.

7. I further hereby AGREES TO INDEMNIFY AND HOLD HARMLESS RELEASEES from any loss, liability, damage or costs, including court costs and attorney fees that may incur due to being a passenger, WHETHER CAUSED BY THE NEGLIGENCE OF RELEASEES OR OTHERWISE.

8. IN SIGNING THIS RELEASE, I, the undersigned ACKNOWLEDGES AND REPRESENTS THAT I have read the foregoing Waiver of Liability and Hold Harmless Agreement, understand it and signed it voluntarily as my own free act and deed: No oral representations, statements, or inducements, apart from the foregoing written agreement, have been made. I am at least eighteen (18) years of age and fully competent. I execute this Waiver of Liability and Hold Harmless Agreement fully intending to be bound by same.

9. I agree that this release, waiver, and indemnity agreement is intended to be as broad and inclusive as permitted by the law and that if any portion of this agreement is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.
