Safe online VR waivers are suitable for business owners

Description and Location of Event: Buena Vista Ranchos Adventure Race (the "Activity"), Tempe Az        Date: May 6th, 2018

The individual named below (the “Participant”) desires to participate in the Activity provided and sponsored by BVR Adventure Race, LLC (the “Sponsor”).  If the Participant is a minor, “I” refers to the undersigned parent or legal guardian of the Participant. If the Participant is an adult, “I” will refer to the Participant.

I AM AWARE AND UNDERSTAND THAT THE ACTIVITY INCLUDES BUT IS NOT LIMITED TO THE FOLLOWING SPECIFIC ACTIVITES: RUNNING, WALKING, SWIMMING, CLIMBING A ROCK WALL, MUD PIT, EATING VARIOUS FOODS, BALANCING, PUZZLES AND OBSTACLE COURSES.  THESE ACTIVITIES INVOLVE THE RISK OF SERIOUS INJURY AND/OR DEATH AND/OR PROPERTY DAMAGE. I ACKNOWLEDGE THAT ANY INJURIES SUSTAINED BY THE PARTICIPANT MAY BE COMPOUNDED BY NEGLIGENT EMERGENCY RESPONSE OR RESCUE OPERATIONS OF THE SPONSOR OR OTHER RELEASEES. I ACKNOWLEDGE THAT THE PARTICIPANT IS VOLUNTARILY PARTICIPATING IN THE ACTIVITY WITH KNOWLEDGE OF THE DANGER INVOLVED AND I HEREBY AGREE TO ACCEPT AND ASSUME ANY AND ALL RISKS OF INJURY, DEATH, OR PROPERTY DAMAGE, WHETHER CAUSED BY THE NEGLIGENCE OF THE SPONSOR, OTHER RELEASEES OR OTHERWISE.

I HEREBY EXPRESSLY RELEASE, WAIVE, COVENANT NOT TO SUE AND DISCHARGE the Sponsor, any of Sponsor’s agents, vendors, the other participants, the Buena Vista Ranchos Homeowners Association or its successor or assigns, any and all sanctioning organization(s) or any subdivision thereof, property owners, whether private homeowners or common area(s) and/or the directors and officials of Buena Vista Ranchos Homeowner’s Association, and/or their successors of the vehicle owners, drivers, pit crews, any persons in any restricted area, promoters, sponsors, advertisers, owners, lessees of premises used to conduct the event and each of them, their officers and employees (together, the “Releasees”), from all liability to the Participant, personal representatives, assigns, heirs and next of kin for any and all loss or damage and any claim or any demand on account of any injury to the Participant, including, but not limited to, death, whether caused by the negligence of the “Releasees” or otherwise, while the minor is in or upon the restricted area and/or competing, officiating in, observing, working for or for any purpose participating in the event.

I agree to indemnify and hold harmless the Sponsor and all other Releasees against any and all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, awards, penalties, fines, costs or expenses of whatever kind they may incur due to the Participant’s presence at or participation in the Activity, observing or working for any purpose participating in the event and caused by the negligence of the “Releasees” or otherwise.

THE UNDERSIGNED PARENTS OR LEGAL GUARDIANS HAVE READ AND VOLUNTARILY SIGN THE MINOR RELEASE AND WAIVER OF LIABILITY AND INDEMNITY AGREEMENT AND FURTHER AGREE THAT NO ORAL REPRESENTATIONS, STATEMENTS OR INDUCEMENTS APART FROM THE FOREGOING WRITTEN AGREEMENT HAVE BEEN MADE.
