1. I understand that the Rides all inherently involve risks and potential dangers, and recognize the use of the Rides may result in accident, loss, damage, or physical injury including, but not limited to, minor injuries, broken bones, paralysis or death. I am not relying on the Festival to provide a list of all the possible risks and dangers that could potentially affect me, either in this Waiver or at any time, now or in the future;

2. I KNOWINGLY AND FREELY ASSUME ALL RISKS OF ANY NATURE, BOTH KNOWN AND UNKNOWN, FOR ANY DEATH, INJURY, OR OTHER DAMAGES, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES to me, my property, or the property of others which may in any way, whether foreseeable or not, arise out of the Rides and/or from the actions – specifically including negligent acts or omissions – of all persons involved either directly or indirectly in the Rides. I FULLY APPRECIATE THESE DANGERS AND VOLUNTARILY ASSUME THESE RISKS and assume full responsibility for my participation;

3. I willingly agree to comply with the stated and customary terms and conditions for participation. If, however, I observe any unusual significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of Festival staff immediately; and,

4. I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE, HOLD HARMLESS, AND COVENANT NOT TO SUE LuminoCity, Inc. their officers, officials, agents, and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the event (“RELEASEES”), WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, LOSS, OR DAMAGE TO PROPERTY WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, TO THE FULLEST EXTENT PERMITTED BY LAW.

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
