RELEASE OF LIABILITY FOR MINOR PARTICIPANTS

READ BEFORE SIGNING

IN CONSIDERATION OF my being allowed to participate in any way in MFC Sports Performance LLC. (“MFCSP”) training programs and related events and activities, I, the undersigned, for myself and my heirs, personal representatives and assigns, hereby acknowledge, appreciate, and agree that:

The risk of injury to participants and damage to property from the activities involved in these programs is significant, including the potential for permanent disability and death, and while particular rules, equipment, and personal discipline may reduce this risk, the risk of serious injury does exist; and,

1) I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF MFCSP, its managers, members, officers, officials, agents, employees, volunteers, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the training programs or others (collectively, the "Releasees") and assume full responsibility for my participation; and

2) I willingly agree to comply with the program's stated and customary terms and conditions for participation. If I have any unusual significant concern in my readiness for participation and/or in the training program itself, I will cease my participation and bring such attention of the nearest official immediately; and

3) I HEREBY RELEASE AND HOLD HARMLESS THE RELEASEES WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property incident to my involvement or participation in these training programs, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law; and

4) I HEREBY INDEMNIFY AND HOLD HARMLESS all the above Releasees from any and all liabilities incident to my involvement or participation in these programs, EVEN IF ARISING FROM THEIR NEGLIGENCE, to the fullest extent permitted by law; and

5) I hereby grant MFCSP a non-exclusive right and license to use my name, image and likeness which may be generated by computer, impersonation, camera, machine or drawn by hand in connection with the training program that MFCSP develops and markets, including, but not limited to, developing, making and marketing programming, print, radio, video reproductions, audio reproductions, films or motion pictures, internet and television promotions, publicity and advertising pertaining thereto, in any manner that MFCSP may deem proper (a "media product").

I understand and to the extent necessary grant the right and license for MFCSP to own the sole and exclusive right to commercially exploit the media product through any and all media whether now known or hereafter discovered, and to copyright, reproduce, distribute, display, perform, sell, license or otherwise dispose of the same for any purpose whatsoever, including the advertising and exploitation thereof, together with alterations of and additions to each of the above. I hereby release, discharge and acquit MFCSP from any and all claims, demands or causes of action that I may hereafter have against it, whether for libel, violation of right of privacy for anything contained in a media product. The rights and license granted herein shall inure to the benefit of MFCSP and its subsidiaries, affiliates, licensees, successors and assigns.

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

I release and agree to indemnify the Releasees from any and all liabilities incident to my minor child’s or ward’s involvement or participation in these training programs and related events and activities as provided above, EVEN IF ARISING FROM THEIR NEGLIGENCE.
