INFORMED CONSENT AGREEMENT-LIABILITY WAIVER - DECLARATION

I confirm that the above information is correct and agree to inform Nemesis Gym of any changes in my status before continuing with my exercise programme.    I hereby state that I have read, understood and answered honestly the pre-exercise questionnaire.  Any questions I had were answered to my full satisfaction.  I also state that I wish to participate in the activities I indicated above provided by Nemesis Gym and hereby waive, release and forever discharge Nemesis Gym from any and all responsibility or liability for injuries or damages resulting in my participation in any activities or my use of any equipment or facilities in the above mentioned activities.  I realise that my participation in these activities involve the risk of injury, so I hereby confirm that I am voluntarily engaging in a level of exercise which has been discussed with me.  I further state that I agree to my personal details (disclosed for the pre-exercise questionnaire) being held on record at Nemesis Gym until such time that I request its destruction.  I confirm that I will avoid training if feeling unwell.

Giving Nemesis Academy your Personal Information:

Please note that where you provide Nemesis Academy with your personal information (name, email address, address, phone and/or other contact information), through a facility provided my website or directly to myself through my enrolment documents ie consultation/parq, you consent to myself:

B) Retaining a record of incoming and outgoing communications (e.g. e-mail). Information in the e-mail we receive and send will not be disclosed to any third party without the permission of the sender unless otherwise in accordance with the General Data Protection Regulation (GDPR). Please note that by providing this information you are giving us your consent to process your personal data as outlined in this Statement.  All information provided will only be controlled by Nemesis Academy.

Opt-in and Opt-out:

Nemesis Academy operates a strict “opt-in” policy for individuals. That means I will not send you any information unless you have requested to receive texts/e-mail.  If you wish to be removed from my direct marketing list and do not wish to receive any further information from Nemesis Academy (opt-out) you can inform me of this by email at [email protected] and request to be removed.

Security of Data:

Nemesis Academy takes seriously its security obligations in respect of your personal data under the Data Protection Acts in order to prevent unauthorised access to, or alteration or destruction of personal data in our possession. All hard copy data is securely locked away at all times and any digital data is password protected.  All data collected on an individual will be kept as long as they remain training within Nemesis Academy services.  All data, including personal information, will be disposed of correctly once a student ceases training, and once adequate time has passed for holding the information in accordance with our Indemnity policy.

Right of Access:

Where you have provided us with your personal data you have a right to be given a copy of your personal data in accordance with article 15 of the GDPR subject to certain exceptions.  To request a copy of your personal data please contact [email protected] 

Right of Rectification or Erasure:

If I hold incorrect information about you, you have the right to have the data amended. You also have the right to have any information you have provided to us be erased.  To request your right to rectification and/or erasure please send your request to [email protected]   This request must be accompanied by a description of the specific personal data you wish rectified.

If you request erasure of your personal data, all your data will be erased subject to the following important notice;

• We are not required to rectify or erase your data where to do so would leave us in breach of our Indemnity policy should any future incident result in a claim and data being required.

How do I use your information?

As a client I process the medical/health information under the legal basis of contract. I require this information in order to:

•   Ensure that there is no medical reason why you should not take part in an exercise program

•   Train you safely and effectively

•   Ensure that I am covered by my insurer to train you

•   To contact and update you re classes, events and general follow up customer care

Medical/health information is classed as special category data and therefore I ensure that I have the appropriate security measures in place to keep your data secure.

Personal details, contact details, personal data (weight and measurements), fitness assessment results, program cards, food intake and any information provided through surveys, feedback forms are processed under the legal basis of legitimate interests. These interests include some or all of the following:

•   To provide the best service we can: to be able to tailor and personalise your exercise and nutrition program so you achieve better results.

•   To ensure that I am meeting my clients expectations.

•   To improve my services and communication with clients.

•   To update clients on information regarding operations and internal communications such as scheduling sessions.              

•   Photos and videos of clients are processed under the legal basis of consent. Therefore, we will only store and use this data if you give explicit consent to do so. You have the right to withdraw your consent at any time.

How long will you keep my data?

I retain your information as long as it is relevant for a period of 7 years after you have stopped training  in case it is needed for legal purposes.

Marketing?

If you are a current client or have recently been a client we may send you marketing emails containing useful content, along with offers and promotions etc

Otherwise, I will only send you marketing emails if you have given consent to do so and have opted in to our email list. You can choose to opt out of our list at any time by clicking on the unsubscribe link at the bottom of each email.

Occasionally some photos/footage will be used on social media.  All due care will be taken to ensure that no one appears in filming or content created by Nemesis Academy without expressing consent to be included.  If you find you do appear in error, and would like an image or video of you to be removed from social media please contact our reception team immediately 01322 335076.

Keeping your data up to date?

You may notify us of any updates, amendments and corrections to your information, or restrict or delete your data (where applicable)

Please note that I may need certain information to enable myself to provide the services you ask for, so changes you make to your data, or restrictions you ask us to make on how I use your data may effect what services I can provide.
