Customers can sign the digital escape room waiver with their mobile devices before coming to the facilities.

I, the below signed (hereafter known as the “Participant”), acknowledge that I voluntarily applied to participate in the escape room game simulation (hereafter known as the “Game Simulation”) at Hour to Midnight (hereafter known as “HTM”).

I acknowledge that:

• The Participant will be placed in a small enclosed area with limited lighting.  HTM is not responsible for the Participant in case of any anxiety or similar responses associated with claustrophobia or other similar disorders.
  
• No coercive or excessive physical force should be used to participate in the Game Simulation.
  
• HTM is not responsible for any bodily harm or injuries incurred from participating in the Game Simulation.
  
• HTM is not responsible for any damage or loss of personal property of the Participant.
  

As consideration of being permitted to participate in the Game Simulation by HTM, I hereby attest that I am in good health and physically able to participate in the Game Simulation, and I forever release HTM and their respective directors, officers, employees, volunteers, agents, contractors, and representatives (hereafter collectively known as the “Releasees”) from any and all actions, claims, or demands that I, my assignees, heirs, distributees, guardians, next of kin, spouse and legal representatives now have, or may have in the future, for injury, death, or property damage, related to (i) my participation in these activities, (ii) the negligence or other acts, whether directly connected to these activities or not, and however caused, by any Releasee, or (iii) the condition of the premises where these activities occur, whether or not I am then participating in the activities. I also agree that I, my assignees, heirs, distributees, guardians, next of kin, spouse, and legal representatives will not make a claim against, sue, or attach the property of any Releasee in connection with any of the matters covered by the foregoing release.

I HAVE CAREFULLY READ THIS AGREEMENT AND FULLY UNDERSTAND ITS CONTENTS. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT BETWEEN MYSELF AND HOUR TO MIDNIGHT, AND SIGN IT OF MY OWN FREE WILL.

I acknowledge that HTM may obtain photographs or videos in connection with my participation in the Game Simulation. I grant HTM permission to display, publish, and distribute such materials.

If signed by Parent or Guardian: I verify that the significance of this Release and Waiver was explained to the Participant and that the Participant understood them.
