In consideration of my participation in HADO PvP event (the “Event”), administered by meleap USA, inc., the undersigned acknowledges, consents and agrees to the following terms and conditions of this release: 1. Assumption of Risk. I am 18 years of age or older and medically fit to participate in the Event. I am aware that the Event involves many risks and dangers and I voluntarily and completely assume all such risks and dangers and the possibility of personal injury, body injury, death, property damage and loss resulting from them during my participation at the Event. By signing this Release, I give my prior permission to meleap USA, inc. to obtain on my behalf such emergency medical treatment as meleap USA, inc. may deem necessary for my health or safety. 2. Release from Liability. I hereby, for myself, my spouse (if any) and my heirs, fully and forever discharge and release meleap USA, inc. and all other participants and sponsoring companies, their respective parent companies, affiliates and subsidiaries and the officers, directors, employees and agents of each (collectively, the “Releases”) from any and all claims whatsoever, WHETHER CAUSED BY NEGLIGENCE OF THE RELEASES or otherwise, which may arise in any way from my participation in the Event. 3. Waiver of Claims. I hereby agree, for myself, my spouse (if any) and my heirs, not to sue or initiate any claim of any nature or kind against the Releases for damages or any other cause of action which I or my heirs may have, including, without limitation, personal injury, bodily injury, death and/or property damage associated with the Event. I hereby, on behalf of myself, my spouse (if any) and my heirs, waive all such claims and/or causes of action. 4. Indemnity Agreement. I hereby agree, for myself, my spouse (if any) and my heirs, to defend, indemnify and hold harmless the Releases from any loss, damage, claims, actions, causes of action, or proceedings of any kind which may be initiated by me, my spouse (if any), my heirs or anyone else in connection with my participation in and/or regarding the Event, including, without limitation, demands, judgments, costs or expenses, incurred by the Releases arising from such proceedings. 5. Agreement to Follow Rules. I hereby agree to strictly follow any and all rules of participation and safety instructions posted and/or conveyed to me. Additionally, I agree to wear all safety equipment required by meleap USA, inc. at the Event. 6. Use of Name and Likeness. I hereby grant meleap USA, inc. the right to use my name, address (city and state), photo, likeness, biographical information, statement, voice and videotaped appearance in perpetuity for trade, production, advertising and/or publicity purposes worldwide in all forms of media now known or hereafter discovered or devised, and on the Internet without future notice, review, approval or compensation in connection with the Event. 7. Governing Law/Arbitration: EXCEPT WHERE PROHIBITED BY LAW, I AGREE THAT ANY CONTROVERSY OR CLAIM ARISING OUT OF MY PARTICIPATION IN THE EVENT SHALL BE SUBMITTED TO FINAL AND BINDING ARBITRATION IN ACCORDANCE WITH THE RULES OF THE AMERICAN ARBITRATION ASSOCIATION OR JAMS/ENDISPITURE. THE PARTIES WILL SHARE EQUALLY IN PAYMENT OF THE ARBITRATOR’S FEES AND ARBITRATION EXPENSES AND ANY OTHER COSTS UNIQUE TO THE ARBITRATION HEARING (RECOGNIZING THAT EACH SIDE BEARS ITS OWN DEPOSITION, WITNESS, EXPERT AND ATTORNEYS’ FEES AND OTHER EXPENSES TO THE SAME EXTENT AS IF THE MATTER WERE BEING HEARD IN COURT). *

I HEREBY ACKNOWLEDGE THAT I HAVE READ EACH OF THE ABOVE PROVISIONS AND THAT I FULLY UNDERSTAND AND ACCEPT EACH OF THEM.
