By signing this waiver, you are waiving certain legal rights.  Please read this agreement carefully and ensure that you understand.  You must be 18 years of age or older to rent equipment and sign this document.

ASSUMPTION OF RISK:  I am fully aware of the risks inherent in the use of the equipment that I am renting from Vineyard Outdoor Rentals.  I recognize that sport, outdoor activities, and water activities are inherently dangerous and could result in serious injury or death.  I hereby voluntarily assume all risks associated with participating in any activity using the equipment that I am renting, including loss, damage, injury, or death, that may be sustained by myself or anyone else that I allow to use the equipment.  I also assume responsibility for any damage done to any third party or any  property caused by the equipment or use of the equipment during the time that I am renting the equipment.  I agree to ensure that no person uses the equipment without my knowledge and consent and assume the risk associated with use of the equipment for any individual that uses the equipment while I am renting it. 

RELEASE OF LIABILITY:  I hereby waive any and all claims that I have or may in the future have against Vineyard Outdoor Rentals and release Vineyard Outdoor Rentals from any and all liability for any loss, damage, expense, or injury, including death, that I or anyone that I allow to use the rental equipment may experience as a result of participation in any activity using equipment rented from Vineyard Outdoor Rentals.  I agree that I will not hold Vineyard Outdoor Rentals liable for any property damage or personal injury to any third party resulting from my participation in use of the rental equipment and will maintain personal responsibility for any damage that myself, others using the equipment, or the equipment itself may cause while in my care. This agreement shall be effective and binding upon my heirs, next of kin, executors, administrators, assigns, and representatives in the event of my death or incapacity. 

FITNESS FOR PARTICIPATION:  I hereby certify that I and anyone else that I allow to use the equipment are physically fit and capable of safely using the rented equipment.  I also certify that I, as well as anyone that I allow to use the rental equipment, have adequate insurance to cover any injury or damage that is sustained by the use of the rented equipment, OR, that I agree to pay the costs of such injury or damage that may occur to myself or any others that I allow to use the rented equipment.  I agree that I am willing to assume the risk of any medical or physical condition that I, or anyone that I allow to use the rented equipment, may have that may be exacerbated or otherwise lead to increased risk of injury by the use of this equipment.  

USE OF PROTECTIVE EQUIPMENT:  I agree that myself or any other person using rental equipment will use standard safety equipment, such as life jackets for any water activities and helmets for any road activities.  Injury caused by failure to do so will be at my own risk and Vineyard Outdoor Rentals shall not be held liable for any injury caused by participant’s failure to use protective equipment. 

DAMAGE, LOSS, OR THEFT OF EQUIPMENT:  I agree to accept responsibility to maintain the condition and whereabouts of all the equipment rented for the entire rental period until properly returned to the care of Vineyard Outdoor Rentals.  I agree to follow all required procedures for proper check in and check out of the rental equipment, as provided to me by Vineyard Outdoor Rentals. If the equipment is damaged while in my care, I agree to pay the full cost for any repairs required to the equipment.  If Vineyard Outdoor Rentals, in its sole discretion, determines that the equipment is beyond repair, or if the equipment is stolen while in my care or otherwise misplaced, I agree to pay the full replacement cost of the item damaged, stolen, or misplaced.  If I do not return the rental equipment in the same condition in which I received it or the equipment is stolen or otherwise damaged, I will be responsible for the repair or full replacement costs. 

USE OF EQUIPMENT BY MINOR CHILDREN:  I hereby agree that the use of any rental equipment by minor children will be under my supervision and that I will be responsible to any injury of the participants.  I also agree that I will be liable to any damage to the property of Vineyard Outdoor Rentals or to the property of any third party caused by the minor’s use of the rented equipment.  

VENUE AND JURISDICTION:  This Release Agreement and any rights, duties, and obligations as between the parties to this Agreement shall be governed by and interpreted solely and in accordance with the laws of the State of Utah and no other jurisdiction.  Any litigation involving the parties to this Release Agreement shall be brought solely within the state of Utah. 

ALTERNATIVE DISPUTE RESOLUTION:  In the case of any legal action, I hereby agree to first attempt alternative dispute resolution at the equally divided cost of both parties in the State of Utah. 

LEGAL COSTS:  I hereby agree to assume any costs associated with any legal actions that may arise between myself and Vineyard Outdoor Rentals.
