
This Agreement for Services−Guided River Trip (“Agreement”) is entered into between Missouri River Outfitters (“MRO”) and (“Guest”) name listed below.
If Guest intends to include additional persons in his or her party, each additional participant shall be personally and individually responsible for each provision contained in this Agreement, and shall individually sign copies of this Agreements and all attachments.
WHEREAS Guest wishes to engage MRO to provide river guided and camping services and MRO wishes to provide Guest such services for the following dates:
NOW THEREFORE, MRO and Guest agree as follows:
1. Services Provided by MRO. MRO shall provide river guide, camping and related services (“Services”) for the specified Trip Dates. Services shall include guidance and instruction, transportation to and from boat landing docks, provision of meals, onshore camping opportunities, and camp set up and break down. As a part of its Services, MRO shall provide professional and knowledgeable guides.
2. Equipment Provided by MRO. MRO shall provide Guest with life jackets, dry bags for personal items, tents, cots and sleeping bags for camping, eating utensils, toiletries and drinkable water.

4. Guest Responsibilities. Guest shall be responsible for Guest’s own travel to and from MRO’s place of business and for Guest’s own accommodations prior to and subsequent to Guest’s Trip Dates. Guest shall be responsible for providing his or her own personal items and clothing suitable for the weather and element conditions. Guest shall also be responsible for ensuring that he or she is in appropriate physical, mental and emotional condition to undertake the demands of the trip.
5. MRO Not Responsible. MRO is not and shall not be responsible for Guest’s personal vehicle or personal items during Guest’s Trip Dates.
6. Liability Release and Waiver. In order for MRO to provide Services, Guest must sign the Liability Release and Waiver Agreement provided by MRO. Failure to sign shall be cause for MRO to deny Services or refund of any applicable deposit made by Guest.
7. Deposit. Reservation of Services requires a deposit of two hundred dollars ($200) per person in order to hold a trip date.
8. Reservation and Minimum Participation. Guest acknowledges that trip dates are tentative subject to a minimum participation of eight persons per trip. If eight persons are not confirmed for the trip date, MRO will refund Guest’s deposit and offer a ten percent (10%) discount for a trip on a different date.

9. Insurance Recommendation. MRO recommends Guest purchase trip insurance if any conflicts are foreseen which would cause Guest to cancel or miss Guest’s trip.
10. Payment. The balance of the Cost is due by Ninety (90) DAYS PRIOR to the scheduled trip date.
11. Cancellation. Deposits for cancellations made more the 90 days prior to the trip date are non-refundable but may be applied to a future trip in the same year of the following year. For cancellations made between fifteen (15) and sixty (90) days from the trip date, pay in full is non-refundable but may be applied to a future trip in the same year or following year. Cancellations made within fifteen (15) days of the trip date are non-refundable and shall be considered forfeited by Guest.
12. Failure to Cancel or Attend. If Guest does not cancel within fifteen (15) days or does not attend the trip for any reason, Guest shall be responsible to MRO for the entire cost of the trip.
13. Cancellation by MRO. In the event MRO is unable to perform any portion of its obligations hereunder for any reason beyond its control, including but not limited to weather, acts of nature or government action, MRO shall refund Guest’s deposit.
14. Governing Law. This Agreement shall be governed by the law of the state of Montana. In the event of any dispute, Guest agrees that venue for the dispute shall take place in Chouteau County, Montana.
