DELIVERY & PICKUP: Lessee grants Lessor the right to enter the location for delivery and return of equipment. The pick-up crew may enter the area by whatever means necessary to secure and facilitate the return of equipment.  Payment must be made at the time of delivery plus any delivery charge applicable to the area delivered to.
DEPOSIT: A deposit of $50.00 must be paid at the time of order. The deposit will be deducted from the total cost of the rental. You will receive all rental items clean and ready for use. Additional charges will be assessed for cleaning if the equipment is returned excessively dirty.
Weather/Cancellation Policy: You may cancel or reschedule a reservation for any reason, including weather, however, the deposit is non-refundable. If at all possible, cancellations must be made at least 24 hours prior to your event. Cancellations must be made by calling 940-730-5819. If no answer, please leave a voicemail. Additionally, you must also follow up on cancellation by emailing us so we can keep it on file. [email protected] Cancellations are given credit with our company for up to one year following the original reservation date. Please call our office to cancel or reschedule a reservation and we will be happy to assist you.
ELECTRICAL SERVICE: Lessee must furnish an electrical outlet rated at 115 volts with an SLO-BLO 20-amp fuse or 30-amp fuse capacity, located within 50 feet of each unit WITHOUT ANYTHING ELSE CONNECTED. Use only ONE extension cord as provided per motor or the motor may burn up due to low voltage as longer extension cords are used. The voltage at the motor must be over 110 volts.
SET-UP: Whitelaw Innovations LLC, dba. Texoma Fun House products must be operated over a smooth, compatible surface such as grass or hard top surface. The unit may NOT be operated on rough surfaces such as rocks, bricks, gravel, or any jagged objects. The unit POSITIVELY MAY NOT be located next to any walls, poles, or ANY FIXED OBJECTS. A MINIMUM of 4 feet clearance on all sides must be observed at all times. Equipment must be anchored in the ground prior to operation.
OPERATION: Adult supervision is required at all times. Observe and obey the rules posted on the unit. Compatible age groups must play on the equipment at the same time. Age groups must not be mixed. The MAXIMUM number of riders of each age group that should play at one time is:

TERMS  OF LEASE: The Lessee or using party shall be in charge of the operation and is fully responsible for operation after receiving unit. Lesso is not responsible for any injuries occurring to Lessee or to any persons using the leased property. Lessee further agrees to hold Lessor free and harmless against any claims; and further. Lessor shall be indemnified for any and all costs incurred due to claims from anyone; including court costs, attorney fees, and other related costs involving the use of leased equipment. With the exception of public schools per the Texas Constitution Article 1ll, section 52 which prohibits public schools from committing public funds toward the payment of any future debt that is of an undetermined amount. In which case wfisd and vendor shall mutually indemnify, defend, and hold harmless each other and its trustees, directors, officers, employees, former employees, volunteers, agents, and legal representatives from all suits, actions, losses, damages, claims, or liability of any character, type, or descriptions, including but not limited to all expenses of litigation, court costs and attorney's fees for injury or death to any person, or injury to any property, received or sustained by any person or persons or property, arising out of, or occasioned by, the intentional or negligent acts or omissions of the other party, or any other person or entity, in the execution or performance of this agreement to the extent permitted by texas law. however, the indemnity provided for in this paragraph shall have no application to any claim for any loss attributable to the sole negligence of the vendor or wfisd. Lessee shall provide their own liability insurance unless otherwise specified. Lessee is responsible for the replacement value of the leased object in the event of theft, vandalism, fire, or any act which may damage or destroy the leased property. Failure to make available equipment delivered to Lessee for Lessor to pick up, or failure to return leased equipment as agreed to, shall make Lessee liable to Lessor for an additional “one-day rental fee” per day until all equipment is returned, or satisfactory arrangement is made with Lessor. If Lessee does not abide by the conditions of this agreement then Lessee must reimburse Lessor for all court and/or attorney fees incurred by Lessor to reinforce this contract.
 
PAYMENT, USE, AND CHECK POLICY:
If it is determined by Lessor that payment has not been received or that Lessor’s equipment is not being operated safely and in accordance with the terms of this agreement, the unit will be picked up before the time arranged, and all equipment is immediately due to be returned to Lessor. Rentals may be paid in full by using VISA, MC, AMEX, Cash, or Check. If paying by check and the bank returns the check unpaid, the Lessee (when notified) must pay in cash the amount of the check plus a $30.00 fee at the Lessor’s office address within two days.  Otherwise, a check will be turned to an attorney for collection with an extra charge of $50.00 plus all legal costs will be due.
