Two parties agree to the contents of retinal digital photography waiver forms when customers sign the waivers.

GENERAL RELEASE

FILM/PHOTOGRAPHY

For good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, I hereby represent to VNC Communications, Inc., doing business as Mr. Youth, and its clients, including Home Box Office, Inc., and their respective affiliate companies, divisions, subsidiaries, licensees, agents, successors, and assigns and/or others working on its behalf and any publishers, or other interested media (collectively "Mr. Youth") as follows:

1.      I hereby give and grant to Mr. Youth a perpetual, worldwide, irrevocable, exclusive, freely assignable with the right to sublicense (by Mr. Youth), royalty-free, and paid-up license to use, reproduce, duplicate, integrate, publish, exhibit, sell, sublicense, or otherwise exploit (collectively, “Use”) my name, image, portrait, picture, likeness, biography, voice, statements (including extractions thereof), performance, and/or signature (as applicable), including any derivatives, modifications, alterations, or edits thereto  (collectively, my “Likeness”)  in any form, including video, photographs, negatives, positives, prints, digital reproductions, audio recordings, or other manifestations thereof and on, or in connection with any media, including the Internet, Mr. Youth’s or other relevant websites, social media sites, blogs, and any and all digital and new media along with any activating or subscription-based technical components or features provided thereon, whether now existing or hereinafter developed (collectively the "Materials") and for any purpose, whether commercial or promotional in nature, including, without limitation for use in advertising and for promoting Mr. Youth and any of its products or services and without any additional notice to, consent by, approval by, or compensation to me. 

2.      I agree that all Materials are exclusively owned by Mr. Youth, including any ideas, statements, announcements, gestures, phrases, or words used in connection with the Materials and that Mr. Youth may copyright and enforce protection of the same, and I hereby release any rights, title, or interest I may have to, or in connection with the Materials.  To the extent available under applicable copyright laws, the Materials will be considered works made for hire and Mr. Youth accordingly owns and controls all rights, title, and interest in and to any such work products.  To the extent that the Materials are for any reason not considered a work made for hire (or for any other reason does not automatically inure to Mr. Youth), I hereby permanently and irrevocably assign to Mr. Youth, to the extent legally permissible, all rights, title, and interest in and to such Materials.  To the extent such assignment is not legally permissible, I hereby permanently and irrevocably grant to Mr. Youth a perpetual, paid-up, exclusive, worldwide, royalty free, and freely assignable license with the right to sublicense all my rights in and/or to the Materials without additional notice to, consent by, or compensation to me.  I hereby waive the benefit of any moral rights and of any similar law anywhere in the world.  I will not authorize any other individual or entity to Use the Materials and I will not make, create, publish, provide or cause the making, creation, publication, or provision of any statement respecting Mr. Youth the Materials or the subject matter thereof that is, or may be interpreted or perceived as disparaging, derogatory, or negative.

3.      I agree that I will not hold Mr. Youth or anyone who receives permission from Mr. Youth responsible for any liability resulting from the use of the Materials in accordance with the terms hereof, including what might be deemed misrepresentation due to editing, alteration, distortion, optical illusion or faulty processing or reproduction which may occur in the finished Materials or any claims of defamation, disparagement, slander, libel, false light invasion of privacy or publicity, intellectual property infringement or the like.  I acknowledge that I may hereafter discover claims in addition to the ones released in this document and I hereby release Mr. Youth from any such unknown and/or unsuspected claims.

4.      Nothing herein shall constitute any obligation on Mr. Youth to make any use of the License granted by me as set forth herein.

5.      I am over 18 years of age and have read this Release prior to execution and am familiar with it and fully understand its content.  I have the right to enter this Release.  This Release shall be governed and interpreted in accordance with the laws of the State of New York and the federal laws of the United States.  The parties agree to submit to the exclusive jurisdiction over all disputes hereunder in the federal and state courts in the State of New York located in New York County.

“I,” “Me”:
